Perhaps I'm missing something here, but I actually read the Act and  
this is all I can find about Habeas Corpus.

In ALL cases it is about alien enemy combatants, so even if  
BuchMcHitler declared a citizen to be an enemy combatant, this act  
would NOT apply.
All of Olbermann's ranting is about abuses of the system against  
Americans.

Olbermann seems way off base here, to me anyway.

Here is the text..

SEC. 7. HABEAS CORPUS MATTERS.
(a) IN GENERAL.—Section 2241 of title 28, United States Code,
is amended by striking both the subsection (e) added by section
S. 3930—37
1005(e)(1) of Public Law 109–148 (119 Stat. 2742) and the subsection
(e) added by added by section 1405(e)(1) of Public Law
109–163 (119 Stat. 3477) and inserting the following new subsection
(e):
‘‘(e)(1) No court, justice, or judge shall have jurisdiction to
hear or consider an application for a writ of habeas corpus filed
by or on behalf of an alien detained by the United States who
has been determined by the United States to have been properly
detained as an enemy combatant or is awaiting such determination.

‘‘(2) Except as provided in paragraphs (2) and (3) of section
1005(e) of the Detainee Treatment Act of 2005 (10 U.S.C. 801
note), no court, justice, or judge shall have jurisdiction to hear
or consider any other action against the United States or its agents
relating to any aspect of the detention, transfer, treatment, trial,
or conditions of confinement of an alien who is or was detained
by the United States and has been determined by the United
States to have been properly detained as an enemy combatant
or is awaiting such determination.’’.

and in any case these are the only things that fall under the prevue  
of the Military court so Olbermann's ranting about putting citizens  
in jail
for speaking out is just plain bull crap..

remember that all of this applies only to ALIENs, so edit out all of  
Olbermann's ranting about abuses against Americans
(actually if you do that, there isn't much left of his rant)

So if you are an ALIEN  enemy combatant and commit any of these  
against the US, you might end up in front of a military tribunal

all and let god sort it out"..  not accepting surrender)

‘‘(8) EMPLOYING POISON OR SIMILAR WEAPONS.
‘‘(9) USING PROTECTED PERSONS AS A SHIELD.—   (Civilians.)
‘‘(10) USING PROTECTED PROPERTY AS A SHIELD.
(11) TORTURE.—
(12) CRUEL OR INHUMAN TREATMENT.
‘‘(13) INTENTIONALLY CAUSING SERIOUS BODILY INJURY.
‘‘(14) MUTILATING OR MAIMING.—
‘‘(17) USING TREACHERY OR PERFIDY.—
‘‘(18) IMPROPERLY USING A FLAG OF TRUCE.—
‘‘(19) IMPROPERLY USING A DISTINCTIVE EMBLEM.—  (Think Hamas using a  
UN ambulance to transport troops.., they did that you know,,)
‘‘(20) INTENTIONALLY MISTREATING A DEAD BODY.—
‘‘(21) RAPE.—
‘‘(22) SEXUAL ASSAULT OR ABUSE.—
‘‘(23) HIJACKING OR HAZARDING A VESSEL OR AIRCRAFT.—
‘‘(24) TERRORISM.—
"(25) PROVIDING MATERIAL SUPPORT FOR TERRORISM.—
‘‘(26) WRONGFULLY AIDING THE ENEMY.—
‘‘(27) SPYING.—
‘(28) CONSPIRACY.—


Anyone have a problem with taking an alien enemy combatant to  
military court for these crimes?
If so, why?
