It applies.

The rules against using the Armed Forces within the US applies only  
to US citizens.

Posse Comitatus Act of 1878 forbids the military from performing  
civilian law, but I'm sure that an Alien Terrorist caught in the US
would easily fall under the enemy combatant status, no matter who  
actually catches him.
